Terms of Use

These Terms of Use (“Terms”) govern your use of KreatInk, a social drawing game and related services operated by Filip Ondrák (“KreatInk”, “we”, “us”, or “our”). By creating an account or using KreatInk, you agree to these Terms.

Please read these Terms together with our Privacy Policy. Your use of KreatInk is also subject to our Privacy Policy, which explains how we collect and use information.

1. Eligibility and Accounts

You must provide accurate information when creating an account and keep your account information reasonably up to date. You are responsible for maintaining the security of your account and for activity that occurs through your account.

KreatInk is not directed to children under 13. If you are under the minimum age required to use the service in your country, you may use KreatInk only with the permission and supervision required by applicable law.

2. Using KreatInk

KreatInk provides drawing prompts, social features, collaborative drawing modes, groups, reactions, comments, profiles, badges, streaks, galleries, and related functionality. Features may change, be added, or be removed as we develop the service.

You agree to use KreatInk only for lawful purposes and in a way that does not interfere with the service or other users’ ability to use it.

3. Your Content

You retain ownership of drawings, photos, captions, comments, and other content that you submit to KreatInk (“User Content”), except for rights you separately grant to others or that apply under law.

By submitting User Content, you grant KreatInk a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, and transmit that content only as reasonably necessary to operate, provide, maintain, secure, and improve the service and the features you choose to use.

You are responsible for the User Content you submit. You represent that you have the rights necessary to submit it and to grant the license described above.

4. Community Rules

You may not use KreatInk to:

Post or share unlawful, fraudulent, threatening, harassing, hateful, or intentionally harmful content
Infringe another person’s copyright, trademark, privacy, publicity, or other rights
Upload malware, malicious code, or content intended to compromise the service or another user’s device
Impersonate another person or misrepresent your affiliation with a person or organization
Abuse, spam, exploit, or attempt to disrupt social, drawing, rating, or other app functionality
Use the service to violate applicable laws or regulations

We may remove content or restrict or terminate accounts when reasonably necessary to enforce these Terms, protect users, protect the service, investigate abuse, or comply with law.

5. Intellectual Property

KreatInk, including its name, branding, software, interface, visual design, logos, and original service content, is owned by or licensed to us and is protected by applicable intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the service or its proprietary components.

6. KreatInk Pro and Subscriptions

KreatInk may offer optional paid features or auto-renewable subscriptions, including KreatInk Pro. The exact features, subscription period, and price will be shown before you confirm a purchase.

Subscriptions purchased through the Apple App Store are billed and managed by Apple. Payment is charged to the Apple ID payment method associated with your App Store account. Subscriptions automatically renew unless cancelled in accordance with Apple’s subscription management rules.

You can manage or cancel an Apple subscription through your Apple account’s subscription settings. Deleting the KreatInk app does not necessarily cancel an active subscription.

Refunds for purchases made through Apple are handled according to Apple’s applicable policies and procedures. KreatInk does not receive or store your full payment card details.

Subscription availability, pricing, taxes, introductory offers, and other purchase terms may vary by country or region and are presented through the App Store.

7. Advertising

KreatInk may display advertisements, including advertising provided through Google Mobile Ads. Advertising and related data processing are also subject to the privacy disclosures described in our Privacy Policy.

8. Third-Party Services

KreatInk may rely on third-party services such as Apple, Google, and Supabase for authentication, payments, notifications, hosting, storage, analytics, advertising, and other functionality. Your use of those third-party services may also be subject to their own terms and policies.

9. Availability and Changes

KreatInk is provided on an evolving basis. We do not guarantee that every feature will always be available, uninterrupted, or error-free. We may modify, suspend, or discontinue features or the service, including for maintenance, security, legal, or product reasons.

10. Disclaimers

To the maximum extent permitted by applicable law, KreatInk is provided on an “as is” and “as available” basis. We make no warranties that the service will always be uninterrupted, secure, accurate, or free from defects.

11. Limitation of Liability

To the maximum extent permitted by applicable law, KreatInk and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

12. Account Termination

You may stop using KreatInk at any time and may delete your account using the available account controls in the app. We may suspend or terminate access where reasonably necessary to enforce these Terms, protect the service or users, or comply with legal obligations.

13. Changes to These Terms

We may update these Terms as KreatInk changes or as required by law. When we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice through the app or website. Your continued use of KreatInk after an update becomes effective constitutes acceptance of the updated Terms to the extent permitted by law.

14. Apple App Store Terms

If you downloaded KreatInk through Apple’s App Store, your use of the app is also subject to Apple’s applicable terms and conditions. Apple is not responsible for providing maintenance or support for KreatInk, and Apple is not a party to these Terms between you and KreatInk, except as otherwise required by Apple’s agreements and applicable law.

Unless a custom end-user license agreement is expressly provided for KreatInk in App Store Connect, Apple’s standard Licensed Application End User License Agreement applies to the app in addition to these Terms.
